Justice Kennedy, Really? (Repeat from 2013)

I was browsing an article in TIME-Online and had this strange wondering about where our Nation is headed now that the cases before the United States Supreme Court regarding same-sex marriage and the DOMA controversy have been heard. A decision should come in a few months.

Justice Kennedy – what are you thinking?

Charles Cooper was extolling heterosexual marriage as the best arrangement in which to raise children when Kennedy interjected: What about the roughly 40,000 children of gay and lesbian couples living in California? “They want their parents to have full recognition and full status,” Kennedy said. “The voice of those children is important in this case, don’t you think?”  (Time)

Maybe I have watched too much TV along the way – but:

Have you, Justice Kennedy, if it please the Court, spoken (or read their depositions) with the 40,000 children in California? And if you have not, would not your statement be “conjecture,” or “hearsay?”

And, if it please the court, most kids want ice-cream and cake for breakfast, video games instead of intellectual pursuits utilizing text books and homework, and they have a tendency to wish for World peace, life without disease and death, and have been known to sleep and/or day dream during critical discussions on the break down of the home in American society.

Justice Kennedy, I am absolutely in favor of listening to children (I do it quite frequently), but I don’t normally base my most important decisions on their counsel. Whether to go to Seaworld or Disney World on our next vacation would most certainly be on my discussion list with them.

So, excuse me for being concerned. But your statement scares me- and I am not even a child.
