Same Song – Second Verse

I read the following statement  as one of the more scary thoughts in American history. Every person in the United Sates of America should be concerned that if it is true with the SCOTUS, it may be true, or will be true soon, of every Court in the United States and it means the end (to one degree or another) to our understanding of “justice under the law.”

What the Supreme Court thinks about same-sex marriage is really a question of what Justice Anthony Kennedy thinks about same-sex marriage. And on Tuesday, we will get to see how far Kennedy — and the Court — is willing to go in recognizing a constitutional right for all couples to marry. (Sam Baker for National Journal)

What Mr. Baker is saying, if I read him correctly, is that the other eight (8) Justices have already decided the case. Four on one side and four on the other. Justice Kennedy is the “swing vote.”

We don’t allow that in this Country, do we? What if the Judge in your case – whatever it is, from a parking ticket to a felony murder charge – has already decided your case before he hears it? Why are we so “up-tight” about finding jurors who have not made up their minds before the case is presented to them? What if the thoughts and actions of the SCOTUS are carried down (set a precedent) to State Supreme Courts, Appellate Courts, State Courts, District Courts, County Courts, or the basic Traffic Court in the city where you live?

“Well, Christian,” you say, “isn’t that already the case much of the time (or, some of the time)?” Don’t we hope not? Don’t we still have hope that our Justice system is based on one being “innocent until proven guilty in a Court of Law?” I understand the case before the SCOTUS is not a “guilty/innocent” case. Give me a break! My concern is about “principle;” a term we don’t hear much anymore in this society.

My job is to tell you how all of this fits with the Truth of Scripture. Governmental Justice is designed to protect the innocent and prohibit the guilty from continuing to harm society. (See Romans 13:1-7)

I don’t think we are headed in that direction any more!
