Basis For Law

I suppose one could get into trouble lecturing outside one’s area of expertise, but then, I have that “pesky” freedom to speak freely – I hope.

Vaughn Walker, U.S. District Judge, according to an article on-line from Associated Press by Lisa Leff and Paul Elias, said the following after overturning a voter approved ban (California) regarding same-sex marriage:

 “The evidence shows conclusively that moral and religious views form the only basis for a belief that same-sex couples are different from opposite-sex couples.”

Isn’t a “moral and religious” view the underlying basis for most of our laws as a Nation? Don’t we ban robbery, murder, rape, cruelty to animals, offspring abandonment, ad infinitum, because of our “moral and religious views?” If we are more than “animals” (who are guilty of all of the above), don’t we have a “moral” responsible to behave in an enlightened way? And where, Your Honor, did that morality come from?

In the same vein, was it not “moral and religious” bias that freed the slaves, gave women the right to vote, condemned cruel and unusual punishment, and established inalienable rights for the citizens of this great Nation?

I suppose one could argue that “law” and “freedom” and “right” sprang from the mind of “ordinary men.” But it is ordinary men who are guilty of practicing crime, devalue individuals, and fail to see the immorality of their actions. So don’t try that argument with me. Maybe you can sell it to the people of California.  I’m having none of it.
