I’m Missing Something

Two things are going to be evident after you read this post. One, I am pretty sure I don’t know what the “job description” is for a Supreme Court Justice. Two, I don’t know why it should matter who appoints a Justice to the Court.

I read an article this morning that leaves me wondering and uncertain about Courts in general. The question I have is this: How does a Judge (or Justice) decide a case? Why would one’s political opinion or prejudice or any other characteristic, positive or negative, be an issue?

Please don’t call me “Pollyanna,” but, aren’t all cases decided based on the LAW and the CONSTITUTION?

Writing about the possibility of Gov. Romney appointing new Justices for the Supreme Court, Yahoo News quoted him as saying, “I respect legal scholars of all backgrounds, but those who are going to be on the bench, if I were lucky enough to appoint them, would be people who believe their job is to follow the law and follow the Constitution. . . .” Does that mean that there are some who don’t? Well, then, that would be a real problem.

Imagine being before a Court of Law where the Judge makes his/her decision not on the law, but rather, how they “feel” about you. (Oh, never mind, been there, seen that)

Now I know that someone will say – what if there is no “law” (rule applicable to the case)? Then the problem belongs to Congress, not the Court. (Civics 101, right?) Are we never going to get this straight again?

Interestingly the same difficulty exists in the Church of Jesus Christ. There are those who have decided they will “make up” stuff, and/or “ignore” stuff, because the TRUTH is a bit difficult to stomach.

No wonder America, and the Church, are on the decline!
